1. The Referral Program Terms are in addition to any agreements between you and Capital One, including the Capital One Terms of Service (collectively, the "Referral Terms"). The Referral Terms are incorporated by reference and apply to your participation in the Refer a Friend Program ("Referral Program"), including, if necessary, for resolving any disputes between you and Capital One related to the Referral Program.
Eligibility
2. The Referral Program is open to primary account holders with an eligible Capital One card in good standing (i.e., not suspended, restricted, delinquent, or in default). You must also be using the most up-to-date version of the Capital One mobile app to access the Referral Program through the app.
When you share your referral link, you disclose that you have a Capital One product. Referral Program offers are not available to Capital One call center employees or employees of Capital One Bank branches or Cafés.
Process
3. You may refer a Friend using a link sent to you or retrieved through your online banking login. You may share the link by email, text message, or any method you choose. Capital One may pre-populate a message if you choose to send the referral link by email or text message, but you may edit the entire message before sending it.
By participating in the Referral Program, you represent and warrant that you have the necessary rights and consent from your Friends to send them your referral link by email, text message, or other means.
Bonus Fulfillment
4. Referral offers and bonuses are individualized and cannot be transferred or redeemed for cash. Referral bonus amounts may vary and are only available for a limited time.
5. To receive a referral bonus: (1) Your Friend must use the referral link you sent and complete the application process through that link. (2) Your Friend must open a Capital One card account. (3) Your Friend must be a new Capital One card customer (meaning they cannot currently have a Capital One Consumer Branded or Small Business card as a primary account holder). (4) Your account must be open and in good standing when the bonus is applied.
6. If your Friend opens a Secured Card Account, they must make the required security deposit to open the account. It may take up to 8 weeks after the account is opened for a referral bonus to appear in your account. Bonuses count toward the maximum bonus allowed for the year in which the bonus is received.
7. If the bonus you earn exceeds the maximum allowable amount, you may receive a partial bonus to keep the total within the yearly limit. Bonuses may be subject to tax reporting requirements, and Capital One may send you Form 1099-MISC. Consult a tax advisor if you have questions about tax implications.
Rules and Restrictions
8. If you upgrade or change your account after sharing a referral link, or while a referral application or bonus is pending, you may not be eligible for a referral bonus. If any of your other Capital One credit card accounts are not in good standing, you may also be disqualified.
9. Spamming, harassment, misrepresentation, and fraudulent activity are prohibited. By participating in the Referral Program, you agree to comply with all applicable laws, including those governing commercial email and telemarketing.
Additional Terms
10. Capital One may alter, change, or terminate the Referral Program at any time. A welcome offer extended to your Friend may vary. Capital One reserves the right to disqualify you for fraud, abuse, or violation of the Referral Terms, which may result in forfeiture of any uncredited referral bonuses.
11. Account closure or suspension may result in the loss of referral bonuses that have not yet been applied to your account.
12. Capital One may delay or choose not to enforce its rights under the Referral Program without waiving the right to enforce those rights at a later time. Referral Program terms may vary by card product.
